A new home warranty, mandated by the Homeowner Protection Act in British Columbia, covers defects in the home’s construction for up to 10 years. It primarily protects buyers from builder’s bankruptcy or faulty construction.

On the other hand, home insurance covers potential damages to the home and its contents due to unforeseen circumstances like fire, theft, or natural disasters. It also provides liability coverage in case someone is injured on the property.

How Do New Home Warranties Work?

New home warranties are mandatory for all new homes built by licensed builders. Depending on the type of property, the warranty commences from the date of occupancy or title transfer. 

The warranty is attached to the home, providing continued protection even upon resale. Homeowners must understand these facets of new home warranties to leverage their benefits fully.

In BC, the scope of the coverage with a new home warranty includes the specifics of the 2-5-10 coverage and the limitations and exclusions inherent in these warranties.

Breakdown Of The 2-5-10 Warranty

Offering comprehensive protection for homeowners, the 2-5-10 warranty in British Columbia entails a three-layered coverage scheme for new homes. It provides two years of coverage on labour and materials, five years on the building envelope, including water penetration, and ten years on the structure of the home.

The two-year labour and materials coverage safeguards against defects in constructing detached homes and non-common property in strata units. The warranty remains effective even upon resale, ensuring extended protection. However, certain exemptions apply, such as new homes built under Owner Builder Authorization and homes on First Nations reserve lands.

Exclusions from New Home Warranty Coverage

Homeowners should be aware of specific exclusions, including manufactured homes, hotels, dormitories, care facilities, floating homes, and, as mentioned above, homes built under Owner-Builder Authorization.

Another unique exclusion applies to homes on First Nations reserve lands. However, builders on these lands may voluntarily offer insurance that meets minimum requirements.

New Home Warranty Coverage Limits

Only two years of coverage are available for defects in detached homes and non-common property in strata units. Certain buildings, such as those for rental purposes, may also be exempt from licensing, fees, and insurance.

Upon receipt of the claim, the warranty provider will assess the claim based on the terms of your coverage. If valid, they will oversee the necessary repairs or replacements. It’s important to note that each warranty provider may have slight variations in their claim process.
